| 摘 要： | 刑事量刑自由裁量权在刑法中有着广泛的存在空间,从社会学角度分析法官的个人因素会影响着量刑自由裁量权的公正行使.因此,尽量完善各种制度来最大限度的限制量刑自由裁量权的行使以达到量刑公正实现同案同判.
