法理视域下的计算机量刑研究

在关于刑事法律正义输出的诸多环节里,量刑是其中的核心环节,国家的意志和法律的思考最终很大程度上都要通过量刑来传达给当事人,并对社会产生一定的预防效果。计算机量刑是一种区别于传统人脑量刑的模式,从其诞生之初,就引起了人们广泛的思考和争论,莫衷一是。以法理学的角度融入这种思考并对有关盲点予以厘定,从而提出计算机量刑的路径选择,以期更好地指导司法实践。

Computer sentencing under the legal sight

In the many aspects of criminal law and justice output, it is no doubt that punishment is the core aspect. The will of the state and the legal thinking are conveyed to the parties by sentencing largely, then produce the preventive effect on the community. Computer sentencing is different from the traditional model in which human brain makes sentence. Since it came into being, it caused a wide- spread refleetion, and debate. This paper reflects on it from the jurisprudence perspective and defines it to propose the path of the com- puter sentencing and provide guidance for judicial practice.
