论当前中国实现“公民服从”法律的现实语境

公民服从和公民不服从是社会政治生活中的一对矛盾。到目前为止,国内外关于公民服从问题的研究较少,大多数学者都将目光集中在对公民不服从理论的分析上,研究成果非常丰富。运用唯物辩证法,对公民不服从含义的界定是理清公民服从内涵的前提。根据我国法治建设国情,将法律作为公民服从的对象,探讨公民服从的内涵、特征及现状;客观看待公民不服从现象,分析其存在的合理性,为公民服从法律的发展保留一定意义上的不服从;最后,分析实现公民服从法律的具体路径,为促进社会和谐进步作出努力。

The real context of China's current implementation law of "civil obedience"

Civil obedience and civil disobedience is a pair of contradiction in social and political life. So far, there is little research a- bout civil obedience subject, the domestic and foreign scholars focus on civil disobedience, their research results are very rich. Utilizing materialist dialectics to define civil disobedience is the premise of clearing our minds about the civil obedienceg intension. According to the situation of our country, we should make law as object of civil obedience, and discuss civil obedience~ intension, characteristic and real context; we should take objective view on civil disobedience, analyse its rationality of existence, and retain a sense of civil disobe- dience; In the end, we should analyse specific countermeasures of civil obedience to promote social harmony and progress.
