| 摘 要： | 随着诉讼民主化、科学化的深入发展，在中国刑事诉讼法中是否应当确立沉默权的问题已引起许多学者的关注。本文从沉默权的起源、发展、现状、内容等方面来阐述，在此基础上分析了沉默权在中国适用的问题。
