专利申请中遗传资源来源的披露研究(三)

在专利申请中披露遗传资源的来源是促进《生物多样性公约》目标的实现与遗传资源的获取和惠益分享法律规范实施的重要措施.尽管一些地区和国家在其立法中认可了披露要求,但是发展中国家积极谋求在既有的国际专利法律制度中建立具有法律约束力的披露要求规则.由于发达国家的坚决反对,修改TRIPS协议以达到认可披露要求的目标并不乐观.当前我国正在制定遗传资源的获取和惠益分享法律以及着手修改专利法》,披露要求应当获得我国上述法律的明确认可.

Study on Disclosure of Origin of Genetic Resources in the Patent Application (Ⅲ)

Disclosure of origin of geneuic resources in the patent application is an important measure to promote the realization of the aims of Convention on Biological Diversity and the implementation of legal rules of access to genetic resources and benefit sharing.Although disclosure requirement has been stipulated by some regional and national legislations,developing countries are seeking actively to establish the binding regulations on disclosure requirement in the existing international patent treaties.Since developed countries oppose this act firmly,it is very difficult that developing counties try to establish the regulations on disclosure requirement through modifying TRIPS Agreement.At present,China is formulating the law on access to genetic resources and benefit-sharing and begins amending Patent Law.Disclosure requirement should be approved clearly by above law.
