摘 要: | 客户名单的商业秘密保护是近年我国司法实践中一个热点也是难点问题,客户名单案件因其自身的特性成为知识产权诉讼中较难处理的一类案件。美国有着世界上最先进的商业秘密法律制度,对客户名单的保护也有许多精妙而独到之处。本文通过对客户名单内涵、外延进行分析,结合众多经典判例,总结出认定客户名单商业秘密属性的若干标准,以期为我国客户名单保护问题提供借鉴和启示。

Abstract: | The trade secret protection of the client list is a hot and difficult problem in China' s judicial practice in recent years. The client list is difficult to handle in a class of intellectual property cases due to its own characteristics. The United States has one of the world' s most advanced trade secret law system, and its protection of client list is also exquisite. This essay tries to sum up a number of criteria on examing whether a client list belongs to trade secrets,by analysing a client list' s connotation and extension, combined with many classic cases of trade secret in order to optimize our client list protection. |
