山西省环保执法合作制度分析

环保执法向来是山西省政府的一项重要职能。在传统的环保执法模式下,各个职能部门各自开展职权范围内的工作,在环保执法中出现了不少问题,为此山西省政府积极探索环保执法新模式,以联合执法的方式集中执法力量,加强行政机关之间以及与其他主体之间的合作,打破部门之间的隔阂,加强执法过程中的管理和责任制度。环保联合执法对山西省环境质量的提高起到了明显的作用,但由于行政联合执法先天不足,与此同时也产生了很多不容忽视的问题,如立法上的缺失、主体资格的不适合、执法程序不规范等,都会影响到环保执法的效果,所以应当通过法治化的路径将环保执法合作纳入正轨。

Analysis of System for Law-enforcement Cooperation on Environmental Protection in Shanxi Province

The law-enforcement cooperation on environmental protection is an important governmental function of Shanxi Province.Under the traditional mode,each functional department only works in its power,which causes many problems.So Shanxi province explores a new mode,that is,the law-enforcement cooperation,under which one functional department cooperates with others.It is a good way to break down barriers between different departments.Meanwhile,problems due to the law-enforcement cooperation can not be ignored,such as defects of legislation,inadequacy of the subject of law enforcement,and inappropriate procedures.All the problems should be solved by a way of ＂rule of law＂.
