论商品房预售款监管制度的完善

摘    要:商品房预售款监管制度是商品房预售监管的核心内容,但我国的商品房预售款监管制度存在明显的缺陷,主要表现为监管主体混乱、监管内容不确定和监管不力所应当承担的法律责任不明确。结合我国国情,可以采取由政府和律师事务所共同对预售款进行监管的措施,同时明确预售款监管的内容和法律责任,来完善我国商品房预售款监管制度。

Abstract:The regulatory system of the funds for the advance booking commodity housing is the core content of the supervision of the advance booking commodity housing commodity house.However,there exist obvious defects in the system in China: subject supervision is in chaos,supervision content is uncertain and the legal obligation is unclear.From the perspective of China's reality,the following measures can be taken perfect the supervision system of the funds for the advance booking commodity housing: the government and the law firm should cooperate to supervise the funds,simultaneously define the supervision content and legal obligation.
