| 摘 要： | 刑事政策概念是刑事政策学的基本范畴。刑事政策概念众说纷纭，不利于刑事政策学科的长远发展。坚持刑事政策学科的独立，是研究刑事政策概念的前提。作为刑事政策学研究对象的刑事政策，不同于刑事公共政策，有别于刑法规范，更不是单纯的犯罪对策。刑事政策是国家基于犯罪原因认识，对已然犯罪采取的以刑罚为主要内容的一系列反应和处置活动。

| Abstract: | The concept of criminal policy is a fundamental category in criminal policy science. Scholars have divergent views on the concept of criminal policy, which is not good for the long-term development of criminal policy science. Insisting on the discipline＇s independence of the criminal policy is the premise to study the concept of criminal policy. As the object of criminal policy study, criminal policy is different from the criminal public policy, from criminal law＇s specifications and from simple crime Criminal policy is a series of and punishments which China takes as main contents of penalty to punish the existing crimes in accordance with the understanding of the causes of crimes. |
