| 摘 要： | 值此我国《继承法》正在讨论修改之际，本文借鉴国外立法经验，结合我国实际，对我国法定继承制度中配偶的法定继承人资格、配偶的法定继承顺序和配偶的法定应继份等三个问题进行分析探讨，并提出自己独到的见解。

| Abstract: | While Chinese Inheritance Law is in raider the discussion for its correction and improvement, we analyze and discuss the three problems of legal qualification, legal order and legal share of spouse inheritance in the present legal inheritance system, according to the foreign legislative practice and our own experiences. It also offers some relevant legislative proposals. |
