| 摘 要： | 我国劳务派遣快速发展,在劳动合同法颁布前,劳务派遣中劳动者、派遣单位、用工单位三者之间关系经常混淆不清,因劳务派遣而发生的侵犯劳动者合法权益的问题层出不穷,由于我国在此方面立法和理论的相对滞后,如何确认劳务派遣中的雇主责任就成为司法机关和仲裁机构处理纠纷的难点。本文试图结合劳动合同法,阐述劳务派遣中三方法律关系,明晰雇主责任,以达到保护劳动者的目的。
