| 摘 要： | 作为中华法系的典范，唐律对后世律典有着深远的影响。其中唐代的和离制度是一整套有体系、有规范的法律制度，文章通过对敦煌文书中放妻书的分析，得出和离是在官方半介入的状态下，有效地利用家族关系实施监督、保证，使当事人在相对平等的情况下，不经过诉讼而达到离异的目的。

| Abstract: | As a model of law system in China, Tang Laws have far-reaching effect on laws of future generations. The Divorce System in Tang Dynasty is a set of standard law system. Through the analysis on Releasing Wife of Dunhuang Documents, divorce system uses family relations to supervise and ensure that the parties can divorce without lawsuit under a relatively equal state involved in semi-authority. |
