美国是西方最早建立司法审查制度的国家,该制度对于维护宪法尊严,强化法院独立地位,实现美国宪法分权制衡原则,发挥了至关重要的作用。另一方面,它作为阶级统治的工具、社会矛盾复杂化的结果,还存在许多难以克服的消极作用。但美国司法审查制度中所蕴涵的有价值的观念、制度或措施是值得我们认真研究对待的,以便对我国的法治建设有所启示。

USA is the earliest country in the west that has established the judicial system, which has played a very important role in protecting constitutional dignity, strengthening independent status of justice and applying separation of powers. However, as a tool of class reign and result of complicate social contradiction, the system has a negative effect which is difficult to overcome. A careful research of its values, institutions or measures may give some implications to the legal construction in China.
