市场经济背景下我国小产权房问题的思考

摘    要:小产权房是指利用农村集体土地开发建设,然后出售给非本集体经济组织成员的房屋。由于其开发建设与我国现行法律相冲突,面临诸多的法律风险,其日益引起社会的关注,应对其进行妥善的解决。对已经建成的小产权房,购买人在履行相应义务后应予以合法化。同时,在市场经济背景下,在严格保证农用地面积的条件下,应赋予农民集体所有的土地与国家所有的土地相同的物权。
