论我国量刑证明标准的构建

在独立量刑程序改革语境下,我国有必要构建科学合理的量刑证明标准体系,其有助于实体正义与程序正义的实现以及诉讼效率的提高。西方国家量刑证明标准的引入具有重要的借鉴意义。我国量刑证明标准应作层次性设计,其中法定量刑情节中的从重、加重、免除情形宜采排除合理怀疑证明标准,从轻、减轻情节宜采清楚且有说服力的证明标准;对酌定量刑情节应采优势证据标准;基于生命权的重要性,对死刑案应采确定无疑的量刑证明标准。

On the Establishment of Standard System of Sentencing Proof in China

Against the context of separate sentencing procedure reform,it is necessary to establish a scientific and reasonable standard system of sentencing proof,which is beneficial to realization of substantive justice,procedural justice,and improvement of legal efficiency.Introduction of the western standard system of sentencing proof is very important.The standard system of sentencing proof in China should be designed to include different levels.The heavier punishment,aggravation punishment and free punishment of legally prescribed circumstances of sentencing should be proofed beyond reasonable doubt;lighter,mitigating circumstances should be proofed clearly and convincingly; discretionary circumstances of sentencing should be proofed probably;death penalty case should be proofed upon clear and convincing evidence leaving no room for an alternative explanation of the facts because of the importance of right of life.
