| 摘 要： | 近年来，因精神病人被强制送治而引起纠纷的案件日益增多。公民将精神病人强制送往医院进行治疗，这是一种什么样的权利，是哪部法律赋予公民可以剥夺他人人身自由的权利。这样的权利应当受到怎样地限制。本文对此进行了分析，认为精神病人送治权实际是一种职责，是监护权的内容之一。我国现行的法律对此规定是很落后的。完全忽视了精神病人的利益。在借鉴国外立法的同时，试图建构适合我国国情的精神病人送治权制度。
