论行政程序的基本功能

行政自由裁量权是行政权的核心问题.行政实体法在授予行政主体自由裁量权后,其本身是无法有效控制其不被滥用的,而行政程序则可以在行政自由裁量权行使之初和过程中控制其行为趋于合理,是一种有效的控制方法.本文通过对行政程序控制行政自由裁量权滥用的探讨,以期加快我国的行政程序建设,实现对行政自由裁量权滥用的有效控制.

It self is unable to control it not to abuse. But the administrative procedure then may control its behavior to tend reasonably at the beginning and in the process of exercising administrative free judgement power, which is an effective control method.
