| 摘 要： | 简评《合同法》特点而引出写作目的是分析合同权利义务终止,将合同的解除与合同权利义务终止分析作比较并介绍其在合同权利义务终止中的地位和作用,进一步明确合同权利义务终止含义,并引据《合同法》第91条介绍终止的法定情况,引出终止的法律后果,据《合同法》第92条、第98条作阐述,总结合同权利义务终止的实践意义。

| Abstract: | Triggered by brief comments on characteristics of Contract Law,and aiming at analyzing the ending of rights and obligations in contracts,we compared the termination of a contract and the ending of rights and obligations in contracts,and discussed its role in the latter to further nail down the meaning of the ending of rights and obligations in contracts. Wequoted Item 91 of Contract Law to explain the legal termination and the results,and Item 92 and Item 98 to sum up the practical significance of ending rights and obligations in contracts. |
