| 摘 要： | 刑法的人权保护机能是社会保护机能的一部分,针对的是社会个体犯罪行为的侵害;人权保障机能针对的是国家权力的滥用。人权保护机能自古以来就具有,与刑法同时产生,而人权保障机能则是近代人权思想的产物。两者紧密联系,又有一定的紧张关系。

| Abstract: | Protection Function of Human Rights in Criminal Law is a part of Protection Function of society,directing against the individual criminality violation;Safeguard Function of Human Rights directs against the state power abusing.The former comes into being with Criminal Law since the ancient times,however the latter is the product of the modern human rights thought.They relates with each other closely and also has the certain tension relations. |
