电影作品著作权的归属与行使:现状、比较与完善

摘    要:《著作权法》第15条将电影作品定性为特殊的合作作品,并将各合作作者对电影作品享有的除署名权外的著作权法定转让给了制片人,与德国、法国的规定基本一致。对于电影作品中包含或改编的原作品而言,应适用《著作权法》第12条关于演绎作品的规定,电影作品著作权人对电影作品的利用须获得原作品著作权人的许可,这与《伯尔尼公约》的要求一致,而德国和法国则规定无须获得原作品著作权人的许可。在修改我国《著作权法》时,应对原作品著作权人和电影作品著作权人利益进行平衡后,选择适当的立法例。

Abstract:Article 15 of Copyright Law regards the cinematographic work as a special work of joint authorship,and stipulates that the copyright of co-authors in a cinematographic work is legally transferred to the producer of the work.This rule is similar with that of Germany and France.With regard to the preexisting works included or adapted in a cinematographic work,Article 12 of Copyright Law could be applied.Before the copyright owner of a cinematographic work exercises his copyright,he must obtain permission from the copyright owner of the preexisting works included.This rule complies with the requirement of Berne Convention,but it differs from that of Germany and France.After balancing interests between the copyright owner of preexisting works and cinematographic works,Article 15 of Copyright Law should be revised according to the proper rule.
