| 摘 要： | 公诉证明标准是指检察机关决定提起公诉时,依据指控证据认定指控事实应当达到的最低程度,它既是一个严肃的理论问题,又是一个重大的实践问题,该标准的科学设定和正确把握,对实现公诉目的,履行公诉职能,保障人权均有重大意义。我国的公诉案件证明标准应当与审判标准相一致,采用"排除合理怀疑"作为公诉证明标准较为合适,但在司法实务中应当准确理解和运用该标准。

| Abstract: | The proof standard of public prosecution should be in accordance with trail standard.In China nowadays,it is reasonable and appropriate to take "excluding reasonable doubt" as the proof standard of public prosecution and this standard should be accepted and applied correctly in judicial practice. |
