| 摘 要： | 环境侵权的特殊性决定了国家应当在环境侵权救济中承担一定的责任。国家应当通过完善环境的行政处理．建立相应的补偿制度和责任保险制度等，保障受害人损害赔偿的迅速、有效地实现。
