| 摘 要： | 台湾刑法犯罪成立要件理论系典型的大陆法系的判断模式,即构成要件该当性、违法性、有责性的三阶段架构,但其本身的矛盾亦引起刑法理论界对该架构的反思。为了使内地的犯罪构成理论更加合理化,我们有必要对台湾的犯罪成立要件理论加以借鉴。
