强制医疗措施性质之思考

强制医疗措施是针对实施了刑法意义上的危害行为的精神病人适用的一种特殊的社会防卫措施。强制医疗是刑事性措施还是行政性措施，学界虽然探讨的不多，但其存在一定争议。笔者认为，只有对强制医疗的性质有明确的界定，才能使该措施在司法实践中发挥其应有的作用。本文拟就强制医疗措施的性质陈述管见，求教于同仁。

The Thought about the Nature of Compulsory Medical Measures

Compulsory medical measures are the special social defensive measures for mental patients who have implemented harm behavior that having the criminal law significance.Whether the compulsory medical measure is the criminal measure or the administrative measure,although academic circles discuss quite few,but it has long been the disputed.The author holds that,the nature of compu lsory medical measures are defined clearly,and play role in judicial practice.The article states opinions about the nature of compulsory medical measures,seeks advice the from colleagues.
