| 摘 要： | 根据利益相关者共同治理理论,债权人作为公司很重要的利益相关者,应当参与公司治理。目前我国债权人参与公司治理严重不足,债权人参与公司治理既是维护自身利益的需要,也有利于提高公司的治理效率。为便利债权人参与公司治理,我国有关法律应作一定修改。

| Abstract: | According to the theory of stakeholders governance together, the creditor, an important stakeholder of the company, should participate in the company’s governance. At present, it is extremely rare for the creditors to participate in the company’s governance in China. The creditor’s participating in the company governance can safeguard their own interests and improve the efficiency of company’s governance. In order to facilitate the creditor to participate in company governance, the relevant laws should be revised to some extent. |
