| 摘 要： | 法治反对解释是一种维护严格法治的立场,也是研究法律的一个角度。对这一命题也许应该进行更宽泛的审视。法治反对解释引发了对传统法律适用方法的呼唤,也引出新的理解基础上的应用方法,因为只有理解了才能够适用或使用。对法治所反对的解释进行界定、法治反对解释的指向以及反对解释的功能等应该有更清晰的表述,以便于人们以更加明确的法治立场捍卫法治事业。
