| 摘 要： | 象以典刑是否在尧、舜时代存在,是否是我国原始社会某一阶段真实的写照,在我国法制史学界争议很大。在此,从刑罚的目的出发,通过分析历史事实,认为在尧、舜时代由于社会条件的限制,民众对政治、财产和性的犯罪都比较少,因为这些犯罪的收益都很小,即使用很少的成本都能够制止住犯罪。因此,在那个特定时代,象以典刑是完全可能存在的。

| Abstract: | It is a very controversial in the circle of China's legal history whether or not Xiang Yi Dian Xing(Exhibiting the Statutory Punishments) existed in Yao and Shun periods and whether or not it is a reflection of a period in the Chinese primitive society.In this paper,based on the objectives of punishment and through analysis on historical facts,it is held that in the Yao and Shun periods,limited by social conditions,there were few crimes of politics,properties and sex because of little gains from these crime... |
