| 摘 要： | 图尔敏是逻辑学实践转向的重要理论先驱之一。他所倡导的论证逻辑理论或实质逻辑既从法律论辩实践中来,又到法律论辩实践中去。《论证的使用》(1958)虽然发起了对符号逻辑范式统治的挑战,但主要是从理论上论证逻辑(形式证明)和修辞学(不诚实的说服)之外的第三条道路——分析实质论证的中介方法。叙述了体现图尔敏逻辑思想的一般论证理论的论证域或论坛。
