| 摘 要： | 管制刑不属于附加刑中的资格刑，并不能完全按照附加刑来适用；管制刑与其他刑种的关系是协调的，它的存在不仅不会破坏现行刑罚体系，反而是刑罚体系完善不可或缺的刑种；管制刑引入刑罚易科制度，有利于解决管制犯在管制期间又犯新罪或又发现漏罪的并罚问题；作为独立刑种的管制刑不宜由不属于独立刑种的缓刑来取代。
