天坑现象与制度迷失——对城市地下空间开发利用中的环境评价标准问题的思考

当前,我国城市地下空间开发利用正风生水起。然而,在城市地下空间开发过程中对环境评估的重视却十分不够,且我国当前城市地下空间开发利用的环境评价体系是缺失的,其主要原因在于城市地下空间开发利用环境评价标准的缺失。国家层面我国现行城市地下空间开发利用中环境评价标准缺失,地方立法活跃。当前,应当确立城市地下空间开发利用中环境评价标准,明确城市地下空间开发利用中环境评价标准的制定基调环境评价标准,以便于事前预测评估、事中监督和事后评估,实现地下空间开发中环境评价标准与环境评价制度的有效衔接。
