对中国农村息讼问题的成因与对策之探究

一旦农民的权益遭到侵害时,农民往往选择的不是起诉来维护自己的合法权利,而是选择息讼。是传统的思想文化制约了农民起诉,农民自身的条件阻碍了农民起诉,农民的经济条件影响了农民起诉,中国目前的法治环境导致了农民选择息诉。可以从以下途径对当前农村息讼的状况加以改善:加强法制宣传,消除农民的思想顾虑;大力加强农村教育,提高农民科学文化素质;发展农村经济,提高农民的法律素质;改善法治环境,增强农民对法律的可信度。

Exploration into the cause of and countermeasure against the dropping of lawsuits in the countryside of China

Once farmers' rights are encroached upon, the farmers usually do not take action to defend their own legal rights, but choose to drop lawsuits. The farmers' not taking action is influenced by many factors such as the traditional culture, their own conditions, their economic conditions and the present legal governance environment. The conditions of dropping of lawsuits can be improved from the following approaches: strengthening the publicity of legal system to get rid of the farmers' ideological misgivings, strengthening the rural education to improve the farmers' scientific cultural quality, developing the rural economy to improve the farmers' legal quality, improving the environment of legal governance to strengthen the farmers' creditability in law.
