| 摘 要： | 作权集体管理制度是维护和实现作权人和与作权有关的权利人的作权权利内容的重要措施。我国新作权法首次明确规定了作权集体管理制度。作权集体管理关系的成立依据应是权利人与集体管理组织之间的行纪行为，集体管理组织应依自己的名义独立的开展活动，依当事人的身份独立的参与管理事务涉讼案件的处理。

| Abstract: | The system of collective administration of copyright and neighboring right is an significant measures to safeguard and implement the rights of copyright owner and neighboring right owner. It is first prescribed by our new copyright law. The ground of collective administration re'aUon is determined in terms of Brokerage for contraction between right owners and collective administration organization. Collective administration organization should be operated independently in the name of itself,and participated in the action,which is relation to its management affairs by the name of parties. |
