| 摘 要： | 在中外立法史上存在着"三根棒棒"与"雄伟石厦"两种立法路线,它们分别从属于不同的文化传统,前劣后优。我国正处在从"三根棒棒"到"雄伟石厦"的转型中,《绿色民法典草案》就是这一转型的见证。同时阐述了"雄伟石厦"立法路线的积极意义以及形式对于民法典的重要性。

| Abstract: | In Chinese and foreign legislative histories, there existed two legislative lines-one is on "three columns" and the other on "Parthenon", which represent two different cultural traditions. However, the former is inferior and the latter is superior. China is experiencing a transformational change from "three columns" to "Parthenon'. \%The Draft of the Green Civil Codes\% is such a testimony of the transformation, explaining the positive function of adopting the "Parthenon" legislative guideline as well as its great bearing on the civil codes. |
