论选举权利平等

选举权利,是指公民在国家代议机关组成人员和其他公职人员选举中选举他人和被他人选举的权利,由选举权和被选举权两部分构成,是公民最基本的政治权利。选举权利平等,是指公民在选举中依照合理法律的规定受到平等的对待,也就是在合理法律面前,条件相同的公民享有相同的选举权利,它包括资格平等和价值平等两方面的内容。选举权利平等是一种"阶梯式"的分层次的平等;是一种存在着"合理差别"的相对平等;是一种"群体平等"和"个体平等"相结合的平等;是一种"机会平等"。选举权利平等,是政治平等的一项主要内容,也是选举的民主性和政治文明的重要体现。保障选举权利平等的基本要求是:合理的法律制度、严格执行法律、完善的救济和裁判机制、平等的经费保障机制。
