民事诉讼地域管辖中的法律规避

尽管我国民诉法对民事诉讼地域管辖作了比较明确的规定 ,但地域管辖中的法律规避问题仍存在种种情形 ,主要有 :一方当事人或者受理法院通过虚列被告、第三人 ,以及人为改变案件性质和案由的方式 ,使得没有管辖权的法院却受理案件 ,损害了另一方当事人的合法权益 ,也破坏了司法公正秩序 ,均属法律规避的违法行

In our country the law of civil action has more clearly stipulated the jurisdiction of district for civil action,but there still exist all sorts of problems of law evasion within the jurisdiction of district.They mainly include:if one litigant or the court accepting a case change the nature of the case and the pattern of brief on purpose by means of a fictitious defendant and third party,the court without the jurisdiction may accept the case.Thus,infringing upon the legal rights and interests of another litigant and breaking the fair minded order of judicature,all this belongs to unlawful practice of evasion of laws.
