| 摘 要： | 在人大法律监督的理论尚不成熟定型、法律监督的国家立法停滞不前的特定历史条件下,一些地方人大出现积极探索法律监督新方式的局面,是应予肯定的常态现象。对其中所流露出的“新理念”和已经尝试的“新方法”,有必要通过抽象概括和实证分析的方法进行系统的辨析、较真和定性,以期让地方人大法律监督理论有所继续发展,创新实践趋于理性和法治化,符合《监督法》的创新得以深化和细化,不符《监督法》的理念和方法得以调整。

| Abstract: | Under the specific circumstances in which the theory of legal supervision of people's congress has not yet taken shape and the national legislation of legal supervision has made little progress,some local people's congresses have started to actively explore new methods of legal supervision,which is a positive phenomenon.However,it is necessary for the new notions and methods to be testified through abstraction,summary and empirical analysis so that the theory of legal supervision of local people's congresses can be further developed and that the renovation practice can be improved.Consequently,what is in accordance with the Supervision Law can be developed and what is not can be adjusted. |
