| 摘 要： | 作者从合法的角度，认为有体动产所有权的转移，是一种合同行为；通过对合意原则和交付原则的比较研究和分析，认为在合意的基础上进行交付，是有体动产所有权合同移转的生效要件。这对于正确理解和完善我国合同法的相关条款将起到积极的作用。

| Abstract: | From the point view of contract laws,the author thinks the transferring of the tangible chattel's ownership is a contract act; comparing and analyzing the acceptability principle and the delivery principle ,the author thinks that the important factors to put into effect the transferring of the chattel's ownership contract is that delivery is based on acceptability, which is playing an active role in correctly understanding and perfecting the provisions of our contract laws. |
