| 摘 要： | 将最密切联系原则作为基本原则是夸大了该原则的作用,这一原则将与法院地国的公共秩序、社会公共利益和国家主权相抵触,则不会被法院地国采用,因而最密切原则是可以被国家主权原则推翻的。所以,最密切联系原则是不可能与国家主权原则等一起成为国际私法的基本原则。

| Abstract: | As a basic principle,the most significant relationship principle exaggerates the role of itself.This principle will conflict with public order of the state of forum,public interests and national sovereignty,so it will not be adopted by the state of forum and can be overthrown by national sovereignty.The most significant relationship principle can not become the basic principles of private international law together with the principle of national sovereignty. |
