论传统知识知识产权保护的正当性——以文化多样性为视角

传统知识是传统部族文化的组成部分,同时也是构成文化多样性的一种文化要素。我国有丰富的民族民间文化资源,然而,面对经济全球化和中西文化的挤压碰撞,我国的民族民间文化出现迅速衰落和萎缩的趋势。多样性是文化发展的重要条件,从文化多样性角度来看,传统知识纳入知识产权保护具有正当性。

Justification of Protecting Traditional Knowledge by Intellectual Property Law

Traditional knowledge is one component of traditional tribe and the ingredient constituting the cultural diversity. China possesses rich resources of native culture and folklore, which, however, under the crushing impact of economic globalization and western culture, experiences rapid downfall and shrinkage. From the perspective of cultural diversity, which is one of the key conditions for its development, it is justified to introduce traditional knowledge into intellectual property system.
