| 摘 要： | 多角度的分析都表明，原生基因资源迫切需要产权制度保护，也应当受产权制度保护。但遗憾的是，现行产权制度不承认原生基因资源的财产属性，拒绝接蚋它们为产权客体。现行产权制度对原生基因资源的态度和政策不仅有失公允，不利于原生基因资源的保护，不利于现代生物科技的发展，还会助长“生物海盗”行为。笔者认为，要从根本上解决问题，必须突破现行知识产权制度框架，建立广义的无形财产权制度。
