| 摘 要： | 任何一项制度在其运行过程都有得与失两个方面,秋审制度也是如此。秋审制度的得主要体现在使一些秋审冤案得到纠正,避免失误,同时它的有效运行,使社会成员得到一定的安全保护,从而稳定了当时的社会秩序,对当时政权运作起到了保护作用。秋审制度的失主要为,在运行过程中对案件改动过大;警戒功能的效果没有达到统治者的目的;秋审运行中体制的局限性也是十分明显的。
