| 摘 要： | 法律上设定缔约过失责任，旨在以法定的责任形式全面保护缔约人的合法权益，以保障交易安全。维护诚实信用原则，维护市场经济秩序。拟从缔约过失责任的特点、构成要件、类型以及赔偿范围等方面予以阐述，以便更好地理解和运用缔约过失责任。

| Abstract: | The fault duty of signing a treaty is formulated in law to protect completely legitimate rights and interests of the person who signs the treaty by legal form of responsibility,thus ensure the safety business,defend the principle of honest and credit and the market economic order. This paper expounds the characteristics,important conditions,types and compensating limits to understand and apply the fault duty of signing a treaty correctly. |
