| 摘 要： | 法律援助的实质是国家通过制度化的形式,对法律服务资源进行再分配,以保障贫弱残疾者不因经济能力、生理缺陷所限而不能平等地获得法律帮助,实现自己的合法权益.它最大限度的彰显人权中的平等权,这可以通过主体的平等与形式上的平等来加以诠释.我国目前法律援助制度在平等权层面上仍然存在着一定的缺陷,应该采取措施加以完善.

| Abstract: | In substance, legal aid is the redistribution of legal service in the form of a country's system. It is to ensure that the poor, the weak and the handicapped can gain legal aid and exercise their legal rights and interests with equality in spite of their low economic ability and physical defects. Legal aid shows the equal rights of human beings to the maximum extent, which can be explained by the equality of both the subjects and the forms. In our present legal aid system, there are still some defects at the level of equality, which should be improved with present and future system development. |
