知识产权法律制度史初探

知识产权法是介于民法学和经济法学之间的一门边缘性学科。知识产权制度是由版权保护制度、专利制度、商标保护制度等组成的一种法律制度。它是随着社会、政治、经济、科技和文化的进步而逐步建立起来的。本文初步探讨了知识产权法律制度产生和发展的历史,阐述了版权保护与活字版印刷术、专利与古代工艺品、商标保护与制造标记的关系,提出了版权保护和专利在我国古代就有萌芽,而商标保护制度的建立却与帝国主义入侵直接相关的初步认识。简要叙述了知识产权法律制度的国际化发展趋势。

A Preliminary Study on the Legal History of Intellectual Property

The intellectual property law is one of the borderline subjeet between civil law and economic law. And the intellectual property system, composed of copyright protection system, patent system and trade mark protection system etc, is one of legal system. It is progressively set up along with the progression of social politics, economy, science and technology as well as culture. The article studies the emerging and developing history of intellectual property system, and showes the relations between the copyright protection and movable type printing technique, the patent and classical craft work, trade mark protection and manufacture symbol.The author puts forword a pre liminary opinion that the copyright protection and patent system have already produced in ancient times of China, but the building of trade mark protection system directly relates to the imperialist incursion. The article also simply relates the international developing tendency of intellectual property legal system.
