| 摘 要： | 物权法中绿地是小区附属设施中唯一可以专有的部分,存在立法理由不明、空间界限不明确和权利属性不明等问题,实践中可能导致物权分配不公、损害其他业主经济和生态权利等。以公益为视角,从制度原因和决策原因论证了绿地只宜共有的合理性。

| Abstract: | In the property law,the green land is an exclusive component in ancillary facilities of estate,there exists some problems such as unclear clegislation cause,undefined space boundary and unclear right property,it may lead to unfair property distribution,and affect other owners' economy and ecological rights.From the commonweal perspective,the rationality of green land community is demonstrated from the system reason and decision reason. |
