论以良法标准指导我国的立法

＂依法治国＂的实质是＂依良法治国＂。良法在内容上必须反映客观规律、体现正义、促进社会进步,同时良法也要求形式上的科学性。由于历史的和现实的各种因素的影响,我国的立法不论从内容上还是从形式上仍存在不少隐患,没有达到良法的要求。我们要明确立法的价值追求和基本理念,确保法律体系的平衡、协调,确立正当的立法程序,努力实现从有法可依到＂良法之治＂,完善我国的法治水平。

On the Standard of Good Law to Guide Legislation in China

＂The rule of good law＂ is the essence of ＂The rule of law＂. Good law must reflects the content of the objective laws and justice, promotes social progress, while good law also requires formal seientificity. Due to historical and practical impact of various factors, China＇ s legislation, whether from the meaning or the form, still has a lot of hidden dangers, far from the requirements of good law. We need to identify the value pursuit and the basic concept of legislation, ensure the balance and coordination of the legal system, establish a legitimate process of legislation. We would make every effort to achieve from ＂the rule of law＂ to the ＂rule of good law＂, and improve China＇ s level of rule of law.
