违约责任中的精神损害赔偿

随着人权保护的力度不断加大，各国的立法、判例开始呈现出对因违约引发的精神损害给予赔偿的发展趋势。并非所有的违约所造成的精神损害都是不可预见的，精神损害的产生也并非与侵权有必然的联系，因此违约并不当然排斥精神损害赔偿。在一些订立合同时即可预见到精神损害的场合，特别是以获取精神利益为目的的合同中，在一定条件下可以允许受害方请求精神损害赔偿。

With the gradual enhancement of human rights protection, the legislation and cases in every country begin to present a developing tendency to give mental injury compensation caused by the breaching of contracts. Not all the mental injury unpredictable, and the arising of mental injury doesn't have inevitable connection with the rights violation either. Therefore the breaching of contracts certainly does not exclude mental injury compensation. On the occasion when mental injury can be predicted while concluding a contract, especially those whose purpose is to obtain mental profits, it may be permitted for a creditor to make a request for mental injury compensation under certain conditions.
