关于失独家庭法律扶助机制的思考

独生子女家庭为我国人口政策和国家可持续发展做出了突出贡献。风险社会中,失独家庭的产生无法避免。大多数失独家庭面临着严峻的经济、养老、医疗等问题。虽然这一现象已逐渐引起了政府和社会的关注,但是目前有关失独家庭的扶助法规存在滞后性和局限性,将失独老人比照三无老人进行扶助的做法也值得商榷。国家、政府以及全社会应强化自身责任和义务,多层次、全方位地及时对失独家庭给予扶助,失独家庭也应努力进行自我调适,以实现自我救助。

Views on the Legal Aid System for Families with the Only Child Lost

The one-child families have made outstanding contributions to China＇s poputatxon poncy aria national sustainable development. However, there is still likeliness that such families would lose their only child under unexpected circumstances and would be faced with severe problems of finance, pension, medical treatment or etc. Although this phenomenon has gradually attracted the attention of the government and society, the aiding laws and regulations are still hysteretic and limited. It is also questionable to support them the same as those three-non elders （non-income, non-living ability, non-dependents）. The central and local government, and the whole society as well, should strengthen the responsibilities and obligations, giving assistance to those families multiply and completely. Meanwhile, the families should adjust and help themselves.
