我国劳务派遣立法的价值取向评析

摘    要:劳务派遣作为一种新型的用工形式目前在我国成为众多用工单位规避雇主责任的出口,产生这一现象的根本原因在于我国相关立法价值取向不明,法律规制不完备。劳务派遣立法应当倾向于对劳动者的人格尊严给予充分的尊重和保护,在劳动力市场上坚持规范的双方性的劳动关系,将劳务派遣限定为辅助性、非主流就业方式的一种,应用于临时性岗位。

Abstract:Labor dispatching as a new form of employment at present in our country has become one method for the multitudinous labor units to avoid the employer’s liability.The cause of this phenomenon is that our legislation value orientation is unknown and the legal system is incomplete.Labor dispatching legislation should be inclined to give full respect and protection to human dignity,adhere to standard and bilateral labor relations in the labor market,and define labor dispatching as an auxiliary,non-mainstream employment mode which is used in the temporary post.
