略论晚清法律移植与中国法律的近代化

法律移植是法律近代化的有效途径,晚清旧法体制的困境与严重的滞后性决定了晚清法律移植的必要性。晚清法律移植作为中国近代法律移植的开端,初步建立了中国法律近代体系与法律原则,在中国法律近代化进程中起了无可替代的推动作用。但另一方面,晚清法律移植也遭遇了法的"本土资源"——中国法律传统的有力抵制,从而决定了晚清法律移植对中国法律近代化推动作用的有限性。近代法制的核心精神——法治,在近代中国并未能真正地建立和实施。
